Cook County state's attorney's office and a former prosecutor have been slapped with a rare sanction by a federal judge who said they "acted in bad faith" during a civil rights case filed against Chicago police and the city.
In his ruling, U.S. District Judge John F. Grady said the office "obstructed" access to files while the lawsuit was argued in court and did not appear to follow its own policies for retaining documents.
The sanction could mean an extra $35,000 in legal fees will be tacked on to a $100,000 settlement in the case.
Grady’s action stems from a 2009 police misconduct lawsuit brought by a Back of the Yards family against the city of Chicago and several police officers.
